1. Introduction & Acceptance
Welcome to the website and practice of Tony Yuile T/A IBS Hypnotherapy NZ ("we," "us," or "our"). This website is operated by Tony Yuile trading as IBS Hypnotherapy NZ. Throughout the site, the terms “we”, “us” and “our” refer to IBS hypnotherapy NZ. By using our website and engaging with our services, you agree to the following terms and conditions. We reserve the right to modify these terms and conditions at any time. It is your responsibility to check this page periodically for changes. Your continued use of our services following the posting of any changes constitutes acceptance of those changes.
These Terms are governed by the laws of New Zealand.
2. Nature of Services (Medical Disclaimer)
The information on this website is provided for general educational purposes and does not constitute medical advice, counselling, or an endorsement of any treatment or therapy. It does not substitute for the advice of your healthcare provider. If you suspect you have a health problem, please seek professional medical help.
Not Medical Advice: You acknowledge that Tony Yuile is a Clinical Hypnotherapist and Coach, not a Medical Doctor, Psychiatrist, or Psychologist. The services provided (including Hypnotherapy, NLP, IEMT, and Coaching) are complementary and are not a replacement for medical treatment, diagnosis, or prescription medication.
Consult Your GP: You agree to consult with your General Practitioner (GP) or medical specialist regarding your diagnosis of IBS or any other condition before commencing this program.
No Guarantees: While the "Freedom From IBS Program" is evidence-based and tailored to assist you, specific results vary from person to person. Under the Consumer Guarantees Act 1993, we guarantee our services will be provided with reasonable care and skill, but we cannot guarantee a specific physiological cure.
3. Appointments, Cancellations & Fees
Agreement and Consent: Before your initial hypnotherapy session, a signed agreement of your consent to participate is required.
Payment Terms: The full price of a session or program must be settled upon receipt of an invoice following the completion of the session/s (unless a payment plan has been agreed upon in writing).
Cancellations & Missed Appointments: Time is reserved specifically for you.
No-Shows: If you do not attend a scheduled appointment and fail to notify us via text, email, or Quenza chat, you will be billed the full price of that session.
Late Cancellation (<24 Hours): If you cancel with less than 24 hours’ notice, a cancellation fee of $50 NZD will be charged.
Standard Cancellation (>24 Hours): There is no fee if you provide more than 24 hours’ notice.
International Clients: Sessions for clients outside New Zealand are charged in US Dollars (USD) unless otherwise agreed.
4. No Guarantees or Refunds
While we strive to provide effective hypnotherapy services, we do not guarantee results as these depend largely on individual behaviour and commitment. Hypnotherapy is not a quick fix or magic solution. It requires your active participation and openness to the process. Thus, we do not offer refunds for services or courses rendered.
5. Minors
We require written consent from a parent or guardian for appointments for children under 16.
6. Privacy & Confidentiality (NZ Privacy Act 2020)
We take your privacy seriously and comply with the Privacy Act 2020 and the Health Information Privacy Code 2020.
Collection: We collect personal information (name, contact details, medical history relevant to IBS) to provide safe and effective therapy.
Storage: We use secure, encrypted third-party software (Quenza) to manage your records. Quenza is fully compliant with HIPAA and GDPR standards. Your data is protected by AES-256 encryption (bank-level security) both in transit and at rest. By commencing treatment, you consent to your data being stored on this platform in accordance with our Privacy Policy. Your notes and records are retained for the period required by NZ law (usually 10 years). You have the right to request access to our written records about you.
Confidentiality: Everything disclosed in sessions is confidential. We will not share your information with third parties without your written consent, except in the following circumstances where we are legally bound to breach confidentiality:
If there is an imminent risk of significant harm to yourself or others.
If required by a court of law or subpoena.
Mailing List: Your email address is used to communicate regarding appointments. If you opt-in to our newsletter, you may unsubscribe at any time via the link in the email or by contacting us directly.
7. Client Rights (Code of Rights)
As a provider of health/disability services in New Zealand, Tony Yuile operates in accordance with the Code of Health and Disability Services Consumers' Rights. You have the right to:
Be treated with respect.
Freedom from discrimination, coercion, harassment, and exploitation.
Dignity and independence.
Services of an appropriate standard.
Effective communication.
Be fully informed.
Make an informed choice and give informed consent.
Support.
Complain.
If you feel your rights have been breached, you may contact the Health and Disability Commissioner (HDC) or the National Council for Hypnotherapy (NCH).
8. Digital Products & Intellectual Property
Refunds: Due to the nature of digital goods, downloadable products (MP3s, PDF guides) are non-refundable once downloaded.
Copyright: The content of the "Freedom From IBS Program," this website, and all downloadable materials are the intellectual property of Tony Yuile.
Permitted Use: You may use these materials for your personal therapeutic use only. You may not share, duplicate, resell, or distribute these materials to others without express written permission.
9. Liability & Website Use
Third-Party Links: This website may contain links to third-party sites. Tony Yuile does not endorse or control these sites and accepts no liability for their content or any damage resulting from their use.
Limitation of Liability: To the maximum extent permitted by NZ law, Tony Yuile shall not be liable for any indirect or consequential losses arising from the use of this website or services. Our total liability shall be limited to the amount paid by you for the services.
10. Intellectual Property Rights
All content, including digital products, text, graphics, logos, images, course material and software used on this site is the property of Mind Body Health Ltd. and is protected by international copyright laws.

Tony Yuile is a qualified clinical hypnotherapist registered with the UK's National Council for Hypnotherapy (NCH). Hypnotherapy is a recognised complementary therapeutic approach that can assist with a wide range of issues, including emotional, behavioural, and psychosomatic challenges.
